Partner Program Terms

Partner Pro is an application-based membership costing $149 per month or $1,490 per year. Applying costs nothing and creates no subscription. Membership begins only after a verified payment made through a secure subscription link issued by Fifth Element.

Membership renews automatically until cancelled. Cancellation takes effect at the end of the current billing period; access continues until that date. Membership fees are governed by our Refund Policy.

Approved, active partners in good standing earn 70% of the eligible collected product subtotal on qualifying referred purchases. Fifth Element retains 30%. Sales tax, discounts, refunds and chargebacks are excluded from the calculation.

Commission is earned only where membership was active and paid at the time of the customer's purchase, and where the referral was attributed to the partner on first touch.

Eligibility is an explicit list. Any service not named above earns no commission, including:

• Business DNA™ Audit ($4,998)
• Momentum Sprint
• Growth Build
• Operations Automation
• Retainers
• Financing, acquisition or performance arrangements
• Every implementation or custom engagement ($15,000 to $250,000)
• Any future product (unless Fifth Element explicitly adds it to the server-side eligibility list)

Every commission is held as Pending for 30 days after the verified payment. A refund, dispute or chargeback within that period reverses the commission in full.

A completed W-9 is required before any commission becomes payable. Fifth Element records only your W-9 completion status and the internal verification record. Tax identification numbers are handled in a separate secure tax and payout process and are never stored in the partner database.

Cleared, payable commissions are paid on the regular payout run. Fifth Element may withhold or reverse a commission where fraud, self-referral, misrepresentation or a breach of these terms is identified.

Referrals are attributed on first touch using your partner code. Where a customer arrives with a partner code and later purchases, that first attributed partner is credited. Attribution is recorded server-side and cannot be changed from a browser.

Partners see referral and commission activity only. Partners never receive customer answers, intake details, report contents, internal notes or other personal information unless the customer has separately consented to that disclosure. Partners may not represent themselves as Fifth Element, quote scope or pricing on our behalf, or make guarantees of business outcomes.

Partner Pro is an independent referral relationship. It creates no employment, agency, franchise, partnership or joint-venture relationship, and no partner has authority to bind Fifth Element, quote scope or pricing, or accept work on our behalf.

Partners must clearly disclose to every prospective customer that they may earn a commission on a referred purchase. Partners must not guarantee revenue, profit, cost savings, AI visibility, search ranking, business value, sale price, financing or any other business outcome.

Applying does not create a subscription and approval alone does not activate membership. Membership begins only after a verified payment. If a payment fails and the subscription becomes past due, membership access is paused until a successful payment restores it.

If you cancel with the period already paid, access continues to the end of that period and your membership shows as Cancellation scheduled; once the period ends it shows as Membership ended. Cancellation does not create an automatic or prorated refund — refunds are governed solely by our Refund Policy. A refund, dispute or chargeback on a referred purchase reverses the related commission.

Fifth Element may update the eligible service list, commission terms or these terms. Changes apply to purchases made after the change takes effect. Either party may end the partnership at any time; commissions already cleared remain payable, subject to these terms.
